La Loi sur les normes d&#8217;emploi pr\u00e9voit une exception qui permet aux employeurs de licencier des employ\u00e9s sans pr\u00e9avis lorsqu&rsquo;il y a un manque de travail pour une raison qui n&rsquo;\u00e9tait pas pr\u00e9vue par l&#8217;employeur. Un licenciement en vertu de cet article peut durer pendant la p\u00e9riode o\u00f9 le manque de travail se poursuit pour une raison impr\u00e9vue.<\/p>\n<h2>La COVID-19 est-elle une raison impr\u00e9vue?<\/h2>\n<p>Selon la jurisprudence relative \u00e0 cet article de la loi, un employeur est tenu de d\u00e9montrer plusieurs crit\u00e8res afin d&rsquo;\u00e9tablir que le licenciement est caus\u00e9 par un manque de travail pour une raison impr\u00e9vue par l&#8217;employeur. L&#8217;employeur doit \u00eatre en mesure de d\u00e9montrer :<\/p>\n<ul>\n<li>qu&rsquo;il y a eu un manque de travail;<\/li>\n<li>que les circonstances \u00e0 l&rsquo;origine du manque de travail \u00e9taient impr\u00e9vues par l&#8217;employeur;<\/li>\n<li>qu\u2019il y avait une raison justifiable d&rsquo;avoir choisi l&#8217;employ\u00e9 \u00e0 licencier.<\/li>\n<\/ul>\n<p>Contrairement au manque de travail caus\u00e9 par l\u2019aggravation des probl\u00e8mes dans l&rsquo;industrie de l&#8217;employeur au cours des ann\u00e9es, la pand\u00e9mie de COVID-19 n&rsquo;est pas une situation qui aurait pu \u00eatre envisag\u00e9e par un employeur. Un manque de travail caus\u00e9 par la pand\u00e9mie de COVID-19 serait consid\u00e9r\u00e9 comme une raison impr\u00e9vue par un employeur. Cela a \u00e9t\u00e9 confirm\u00e9 par la province du Nouveau-Brunswick sur sa page \u00ab Lignes directrices sur la COVID-19 \u00e0 l\u2019intention des entreprises \u00bb. Comme la COVID-19 est une raison impr\u00e9vue par un employeur, les employeurs qui licencient des employ\u00e9s pour un manque de travail caus\u00e9 par la COVID-19, pour la dur\u00e9e pendant laquelle le manque de travail se poursuit en raison de la COVID-19, ne sont pas tenus de donner un pr\u00e9avis aux employ\u00e9s.<\/p>\n<p><strong>Toutefois, bien que les employeurs ne soient pas tenus de donner un pr\u00e9avis de licenciement dans ces circonstances, cela n&rsquo;\u00e9limine pas n\u00e9cessairement les obligations de licenciement de l&#8217;employeur en vertu de la common law qu\u2019il doit \u00e0 un employ\u00e9 lorsque la relation de travail prend fin.
